These Terms of Service ("Terms") govern your use of Bloodstonk at bloodstonk.com, a free fantasy-bloodstock game ("Bloodstonk", "we", "us"). By creating an account or using the service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Bloodstonk.

Eligibility

You must be at least 18 years old to create an account and use Bloodstonk. By using the service you confirm that you meet this requirement and that you are able to enter into a binding agreement.

A free fantasy game — no wagering

Bloodstonk is a free-to-play fantasy game. You draft real horses catalogued at real sales using virtual budgets only. There is no real-money wagering, no purchase is necessary, and nothing in the game has cash value. Bloodstonk is not a betting, gambling, or investment service, and nothing in it is financial, betting, or bloodstock advice.

Your account

You are responsible for the activity on your account and for keeping your sign-in details secure. Please give accurate information when you sign up and keep it current. One account per person. Notify us promptly at support@bloodstonk.com if you believe your account has been accessed without your permission.

Acceptable use

You agree not to:

• Break the law or infringe anyone's rights while using the service.
• Use bots, scrapers, or other automated means to access the service, create accounts, or make picks, or otherwise cheat, exploit bugs, or manipulate scoring or leaderboards.
• Choose usernames or submit content that is abusive, harassing, obscene, or otherwise objectionable.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the service or its infrastructure.

Intellectual property

The Bloodstonk name, the game, its software, design, and content are owned by Bloodstonk or its licensors and are protected by applicable law. We grant you a limited, personal, non-transferable licence to use Bloodstonk for its intended purpose. Horse, sale, and pedigree information is provided for the game and may originate from third-party sources; while we aim for accuracy, we do not guarantee it. Real horses, sales, and auction houses are referenced for identification only; for trademark and affiliation notices, see our Legal page.

Disclaimers

Bloodstonk is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy of data, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that data (including horse, sale, or scoring data) will be accurate or complete.

Limitation of liability

To the fullest extent permitted by law, Bloodstonk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) Bloodstonk. Because Bloodstonk is a free game, our total liability to you for any claim relating to the service is limited to the amount you paid to use it, which is zero. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

Suspension and termination

You may stop using Bloodstonk at any time and delete your account from your profile or by emailing us. We may suspend or terminate your access if you breach these Terms, misuse the service, or where we reasonably need to protect the service or other users. On termination, your right to use the service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

Changes to the service and these Terms

We are actively developing Bloodstonk and may change, add, or remove features at any time. We may also update these Terms; when we do, we will revise the "last updated" date above and, for material changes, take reasonable steps to let you know. Continuing to use Bloodstonk after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules, and the courts located in Louisiana will have jurisdiction, except where mandatory consumer-protection laws of your country of residence provide otherwise.
